The following Terms and Conditions together with the general information contained on our website form the basis of the agreement with The Winter Adventure Company Ltd ("we" and/or "us") trading as The Winter Adventure Company whose registered office is situated at 51 High Street North, Crail, KY10 3RA. Please read them carefully as they set out our respective rights and obligations.
These Booking Conditions only apply to holiday arrangements which you book with us in the UK and which we agree to make, provide or perform (as applicable). All references in these Booking Conditions to "holiday", "booking", "contract", "package", "tour" or "arrangements mean such holiday arrangements.
1. Package holidays
A "package holiday" is a combination of at least two out of (1) transport (2) accommodation or (3) other tourist services (not ancillary to any transport or accommodation and forming a significant part of the arrangements) where booked through us at the same time , for which payment is made to us and which last at least 24 hours or include overnight accommodation.
If you book a package holiday through us, then the package will have been supplied by a single third party supplier ("Third Party"), therefore your contract for that package will be with that Third Party. The Third Party's own terms and conditions will apply to that contract. We act as agent only for that Third Party and we have no liabilty in relation to that package or for the acts or omissions of the Third Party or any supplier(s) or other person(s) or party(ies) connected with that package.
2. Accommodation only bookings
For accommodation only bookings, we act as agent on behalf of the accommodation supplier ("Accommodation Supplier"). Your contract will be with the Accommodation Supplier concerned. The Accommodation Supplier may have their own terms and conditions and if so these will apply to that contract. Copies available on request.
3. Making a booking
To make a booking, you must telephone our reservations department on 0033 4 67 89 48 63. The person making the booking will be deemed to be the party leader. The party leader must be at least 18 and must be authorised to make the booking on the basis of these Booking Conditions by all persons named on the booking. In making the booking the party leader confirms that he/she is so authorised. All bookings are subject to these conditions. The party leader is responsible for making all payments due to us.
Once we have received your booking and deposit, we will confirm your arrangements by issuing a confirmation invoice. This invoice will be sent to the party leader. Please check this invoice carefully as soon as you receive it and contact us immediately if any information or any other document appears to be incorrect or incomplete as it may not be possible to make changes later. As we act only as an agent we will have no responsibility for any errors in any documentation except where these errors were made by ourselves.
4. Contract
When we confirm the booking a legally binding contract between you and the third pary supplier comes into existence.
5. payment
In order to confirm your arrangements, a deposit per person must be paid at the time of the booking. For the Hotel Rose des Alpes, Chalet xxx, Auberge du Grand Paradis and Chalet Sundance this amount is 150.00 GBP. For all other accommodation in our programme we will advise of the deposit amount required at time of booking. It is the responsibily of the party leader to ensure that we receive for deposit and final payments, one payment for the amount due by either cheque or bank transfer.
The balance of the cost of your arrangements must be received by us by the date stated on your confirmation invoice. Reminders are not sent. If we do not receive all payments due (including any surcharge where applicable) in full and on time, we acting as agent on behalf of the Third Party or the accommodation supplier reserve the right to treat your booking as cancelled by you. In this case the cancellation charges set out in 8 will be payable.
6. Prices
As we act only as agent for the Accommodation Supplier or Third Party concerned, we reserve the right to pass on to you in full all additional costs and charges of whatever nature imposed by the Accommodation Supplier or the Third Party in accordance with its own terms and conditions.
We reserve the right to correct errors in both advertised and confirmed prices. We will do so as soon as we become aware of the error. Please note, changes and errors occasionally occur. You must check the price of your chosen arrangements at the time of booking.
7. Changes made by you to confirmed arrangements
Should you wish to make any changes to your confirmed arrangements, you must notify us in writing as soon as possible. Whilst we endeavor to assist , we cannot guarantee any such requests will be met. Where they can be met, an amendment fee of 20.00GBP per person/per booking will be payable together with any costs or charge incurred or imposed by the Accommodation Supplier or Third Party.
8. Cancellation
The applicable cancellation charges will be those imposed by the Accommodation Supplier or Third Party. Please see their own terms and conditions or ask at the time of booking for further details.
If the Accommodation Supplier or Third Party changes or cancels your booking we will pass on the new details to you together with any compensation that the Accommodation Supplier or Third Party may offer. As agents only for the Accommodation Supplier or Third Party we cannot accept any liability for any changes or cancellations made to these bookings.
9. Insurance
You must ensure that each memebr of your party has adequate travel insurance. Please read your policy details carefully and take them with you on your break. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particuar needs, including all winter sports/activites which you may wish to take part in.
10. Force Majeure
Except where otherwise expressely stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations or those of any Third Party or Accommodation Supplier is prevented or affected by you or you otherwise suffer any damage or loss as a result of Force Majeure. In these Booking Conditions Force Majuere means any event which we or the Accommodation Supplier or Third Party could not, even with due care, foresee or avoid. Such events may include war or threat of war, rior, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.
11. Company Liabilty
We promise to make sure that all parts of the holiday we have agreed to arrange, perform or provide as part of our contract with you are performed or provided with reasonable skill and care . The parties hereon accept that the conditions contained in this contract are reasonable and that in the event that any of the conditions are found to be unlawful or enforceable having due regard to the generality of the foregoing, that in any event the maximum liability owed by The WInter Adventure Company Ltd to a client in respect of any act or omission by us or any of our servants or agents shall be limited to 25% of the price paid by such client to us and without prejudice to the foregoing we accept no responsibility for any consequential losses suffered by any of our clients howsoever caused.
12. Client Behaviour
Any loss or damage caused by the Client or members of his/her party to property belonging to The Winter Adventure Company Ltd, it's agents, suppliers or staff, must be paid for in full. The client accepts responsibility and liability for all members of his/her booking and agrees that The Winter Adventure Company Ltd shall be entitled to recover any cost from the client (estimated by us if not known)
Clients are responsible at all times for the safety of their personal luggage, documents and all ski equipment including rental equipment.
The Winter Adventure Company Ltd reserve the right, at our discretion, to terminate without notice and liability the holiday of any person whose behaviour is such that it is likely to disrupt the enjoyment of others on holiday or cause damage to any third party. Full cancellation charges apply and The Winter Adventure Company Ltd will be under no obligation whatsoever for repatriation or any costs incurred by the client or members of his/her party. As such the braech of this clause by any one member of a clients group may result in The inter Adventure Company Ltd teminating the holiday of all members of the Clients group.
13. Conditions of Suppliers
For all types of bookings, many of the services which make up your arrangements are provided by independent suppliers. Those suppliers provide these services in accordance with their own terms and condtions. Some of these terms and conditions may limit or exlude the supplier's liability to you, usually in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the suppliers's liability to you, usually in accordance with applicable International Conventions. Copies of the relevent parts of these terms and conditions are available on request from ourselves or the supplier concerned.
14. Complaints and Problems
In the unlikely event of any problem occurring during your holiday, a complaint must be made immediately to the Resort Manager. Claims can only be considered when this procedure has been followed.
15. Passports, Visas and Health Requirements
British or European citizens require a full passport or valid travel document for the holidays we offer. Requirements may change and you must check the up to date position in good time before departure. It is your responsibility to ensure that you are in possession of all necessary travel and health documents before departure - including ensuring the validity extends beyond the end date of your holiday. We regret we cannot accept any liability if you are refused entry onto any transport or into any country due to failure on your part to carry correct documentation.
